Following a $12 million renovation, Justin Hemmes is now facing eviction from the Coogee Pavilion after owner David Kingston claims his tenant was two days late with rent.

Documents submitted to the Supreme Court also indicate Hemmes has conducted unauthorised building work on the rooftop bar.

According to the Sydney Morning Herald, Kingston claims Hemmes failed to inform him about the extent of the renovations, and alleges he was under the impression the building works would only be minor.

A Merivale spokesperson stated they are “extremely disappointed” that they have been forced to instigate Supreme Court proceedings to protect their “considerable investment” in the Coogee Pavilion.

“As these proceedings are now before the Court, it would not be appropriate for Merivale to provide any comment on the matter. However, we would like to take this opportunity to thank our guests and well-wishers on social media for their staunch support and astute understanding of the current situation.”
