SABMiller’s failed bid to block a new craft beer trademark came just days after the multinational brewer won a separate trademark claim against a West Australian juice retailer.

SABMiller successfully argued that the logo proposed by Java Juice, which bids itself as “the original juice bar in Perth”, was too similar that of SABMiller’s Appletiser and Grapetiser fruit juices (pictured below).

The Australian Trademarks Office accepted that consumers may be led to believe that Java Juice was in some way connected with the two brands, which were first sold in Australia in early 2005 and are now available in 4500 outlets across the country.

Hearing Officer Bianca Irgang found in favour of SABMiller and awarded costs against Java Juice.
